Terms and Conditions

The terms and conditions contained herein and those described on the Company’s website (to be read in combination and referred to herein in their entirety as “The Agreement”) shall be binding for each and every customer of The Gold Movement.  The following words have special meanings, but will not be put in bold: us, our,  we – The Gold Movement, a company; and you, your – the person, firm, organization or company who we contract with.

Paypal and Direct Deposit Payments

If you choose to be paid via Express Cash Payment or PayPal, you waive the thirty day guarantee. As soon as your items are evaluated, you will be paid and the items will be sent to our refinery for melting. If you would like to be notified before your payment is processed, please let us know to contact you before we processing your payment.

Requirements for Use

Every customer must be at least eighteen (18) years of age in order to sell precious metals or jewelry to The Gold Movement. In addition, every customer of The Gold Movement must be the actual legal owner of any and all gold, jewelry, and other property sold or attempted to be sold to The Gold Movement, and every customer must be acting on his or her own behalf and not as the agent or representative of another person. The Gold Movement may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.

Limitation of Liability

This limitation of liability shall be binding on each and every customer and any third party, including but not limited to, the customer and the customer’s successors, assigners, insurance carriers and any other individual or entity asserting any right or claim relating to customer’s transaction with The Gold Movement. In no event shall The Gold Movement be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence, except as stated herein. In no event shall The Gold Movement be liable to any third party, including any insurance carrier. The Gold Movement shall not be liable for any subrogation claim brought by the customer’s insurance carrier, and, by submitting an item to The Gold Movement, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

The Gold Movement’s liability is and shall be expressly and specifically limited to the LEAST of the following sums:

The liquidation value placed on the total contents by The Gold Movement in The Gold Movement’s sole discretion.

The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents begin submitted to The Gold Movement, The Gold Movement’s liquidated value shall be conclusive and binding and further, that in no event shall The Gold Movement’s Liability exceed One Thousand ($1000.00) Dollars.

The Gold Movement shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the items, customer explicitly and expressly accepts this limitation of liability.

Referral Program

5% referral checks are available when the customer actually makes a sale to The Gold Movement (TGM). Gold must become property of TGM. TGM may take up to a month to process a referral check due to the 30-day holding period. The 5% referrer bonus is only valid on scrap gold, silver, and platinum jewelry sales. Coins, watches and diamonds are excluded from the referral program. Due to the small profit margin on Bullion/numismatic coins, there is no 5% referral bonus on these types of purchases.

Material Return

If you change your mind about selling your material or are dissatisfied with the amount of the payment you received, you must notify us immediately. If we do not hear from you by telephone or within thirty (30) calendar days of the date on the check or payment receipt, your material will be processed by our refiner. You must return the uncashed/original check before we will return your material. This time limitation cannot be waived for any reason. The Gold Movement will not be responsible for any loss or damage of any kind if the time limitations are not strictly followed. (This 30-day time period will be waived and no returns will be accepted if you choose to be paid via Express Cash Payment or PayPal.)
